Rule 12
Exemptions from certain child-related obligations
Switches off Sections 9(1) and 9(3) for the classes and purposes listed in the Fourth Schedule, subject to conditions.
Read this before you cite anything here
These pages are a plain-English restatement, written to help you find the right provision and understand what it asks of you. They are not the text of the statute, and nothing here should be quoted as though it were. Section and rule numbers are exact, and every page names its source.
What it says
- 01
- Sections 9(1) and 9(3) do not apply to the classes of Data Fiduciaries listed in Part A of the Fourth Schedule, subject to the conditions stated there, or to the purposes listed in Part B of that Schedule, subject to its conditions.
In practice
The exemption is class-and-purpose bound, not company bound. A healthcare establishment in Part A is exempt only for the processing tied to its function, so the same organisation can be exempt for clinical records and fully caught for its marketing list. A consumer product aimed at parents rarely fits any Part A class.

Rule 12 is not in force yet. If that date moves, or the Board says anything about how it will be read, you will get one email about it and nothing else.
